Scholars have generally assumed that authoritarianism and rule of law are mutually incompatible. Convinced that free markets and rule of law must tip authoritarian societies in a liberal direction, nearly all studies of law and contemporary politics have neglected that improbable coupling: authoritarian rule of law. Through a focus on Singapore, this book presents an analysis of authoritarian legalism. It shows how prosperity, public discourse, and a rigorous observance of legal procedure have enabled a reconfigured rule of law such that liberal form encases illiberal content. Institutions and process at the bedrock of rule of law and liberal democracy become tools to constrain dissent while augmenting discretionary political power — even as the national and international legitimacy of the state is secured. This book offers a valuable and original contribution to understanding the complexities of law, language and legitimacy in our time.

States that now contemplate constitutional reform often grapple with the question of whether to constitutionalise social rights. This book presents an argument for why, under the right conditions, doing so can be a good way to advance social justice. In making such a case, the author considers the nature of the social minimum, the role of the court among other institutions, the empirical record of judicial impact, and the role of constitutional text. He argues, however, that when enforcing such rights, courts ought to adopt a theory of judicial restraint structured around four principles: democratic legitimacy, polycentricity, expertise, and flexibility. These four principles, when taken collectively, commend an incrementalist approach to adjudication. The book combines theoretical, doctrinal, empirical and comparative analysis, and is written to be accessible to lawyers, social scientists, political theorists and human rights advocates.

What do all human languages have in common and in what ways are they different? How can language be used to trace different peoples and their past? Are certain languages similar because of common descent or language contact? Assuming no prior knowledge of linguistics, this textbook introduces readers to the rich diversity of human languages, familiarizing students with the variety and typology of languages around the world. Linguistic terms and concepts are explained, in the text and in the glossary, and illustrated with simple, accessible examples. Eighteen language maps and numerous language family charts enable students to place a language geographically or genealogically. A supporting website includes additional language maps and sound recordings that can be used to illustrate the peculiarities of the sound systems of various languages. 'Test yourself' questions throughout the book make it easier for students to analyze data from unfamiliar languages.

The Cold War ideological battle with universal aspirations has given way to a clash of cultures as the world concurrently moves toward globalization of economies and communications and balkanization through a clash of ethnic and cultural identities. Traditional liberal theory has confronted daunting challenges in coping with these changes and with recent developments such as the spread of postmodern thought, religious fundamentalism, and global terrorism. This book argues that a political and legal philosophy based on pluralism is best suited to confront the problems of the twenty-first century. Pointing out that monist theories such as liberalism have become inadequate and that relativism is dangerous, the book makes the case for pluralism from the standpoint of both theory and its applications. The book engages with thinkers, such as Spinoza, Kant, Hegel, Rawls, Berlin, Dworkin, Habermas, and Derrida, and with several subjects that are at the center of current controversies, including equality, group rights, tolerance, secularism confronting religious revival, and political rights in the face of terrorism.

A handy beginner's guide, this textbook introduces the various stages of linguistic fieldwork, from the preparation of the work to the presentation of the results. Drawing on over forty years of fieldwork experience between them, in over two dozen languages, the authors pack the book with examples and anecdotes from their experiences and include practical exercises for students to test what they have learned. Independent of any particular perspective, the methods can be applied to a wide range of fieldwork settings, for projects with very different theoretical backgrounds and without the need to travel too far. The book covers 'traditional fieldwork' such as language description and documentation, as well as less typical methods, including language contact and quantitative studies with experiments or questionnaires.

In this 2009 book, van Dijk presents a new theory of context that explains how text and talk are adapted to their social environment. He argues that instead of the usual direct relationship being established between society and discourse, this influence is indirect and depends on how language users themselves 'define' the communicative situation. The concept van Dijk introduces for such definitions is that of context models. These models control all language production and understanding and explain how discourse is made appropriate in each situation. They are the missing link between language and society so far ignored in pragmatics and sociolinguistics. In this interdisciplinary book, the new theory of context is developed from a linguistic and psychological perspective. The theory is applied to the domain of politics, including the debate about the war in Iraq, where political leaders' speeches serve as a case study for detailed contextual analysis.

Spelling matters to people. In America and Britain every day, members of the public write to the media on spelling issues, and take part in spelling contests. In Germany, a reform of the spelling system has provoked a constitutional crisis; in Galicia, a 'war of orthographies' parallels an intense public debate on national identity; on walls, bridges and trains globally, PUNX and ANARKISTS proclaim their identities orthographically. The way we spell often represents an attempt to associate with, or dissociate from, other languages. In Spelling and Society, Mark Sebba explores why matters of orthography are of real concern to so many groups, as a reflection of culture, history and social practices, and as a powerful symbol of national or local identity. This 2007 book will be welcomed by students and researchers in English language, orthography and sociolinguistics, and by anyone interested in the importance of spelling in contemporary society.

The function of language is to transmit information from speakers to listeners. This book investigates an aspect of linguistic sound patterning that has traditionally been assumed to interfere with this function — neutralization, a conditioned limitation on the distribution of a language's contrastive values. The book provides in-depth, nuanced and critical analyses of many theoretical approaches to neutralization in phonology and argues for a strictly functional characterization of the term: neutralizing alternations are only function-negative to the extent that they derive homophones, and most surprisingly, neutralization is often function-positive, by serving as an aid to parsing. Daniel Silverman encourages the reader to challenge received notions by carefully considering these functional consequences of neutralization. The book includes a glossary, discussion points and lists of further reading to help advanced phonology students consolidate the main ideas and findings on neutralization.

National Human Rights Institutions (NHRIs) — human rights commissions and ombudsmen — have gained recognition as a possible missing link in the transmission and implementation of international human rights norms at the domestic level. They are also increasingly accepted as important participants in global and regional forums where international norms are produced. By collecting innovative work from experts spanning international law, political science, sociology and human rights practice, this book critically examines the significance of this relatively new class of organizations. It focuses, in particular, on the prospects of these institutions to effectuate state compliance and social change. Consideration is given to the role of NHRIs in delegitimizing — though sometimes legitimizing — governments' poor human rights records and in mobilizing — though sometimes demobilizing — civil society actors. The volume underscores the broader implications of such cross-cutting research for scholarship and practice in the fields of human rights and global affairs in general.

Global distributive justice is now part of mainstream political debate. It incorporates issues that are now a familiar feature of the political landscape, such as global poverty, trade justice, aid to the developing world and debt cancellation. This is the first textbook to focus exclusively on issues of distributive justice on the global scale. It gives clear and up-to-date accounts of the major theories of global justice and spells out their significance for a series of important political issues, including climate change, international trade, human rights and migration. These issues are brought to life through the use of case studies, which emphasise the connection of theories of justice to contemporary politics, and 'Further Issues' sections, which discuss emerging debates or controversies that are likely to command increasing attention in the coming years.

Gender and sexuality have been neglected topics in the history of Chinese civilization, despite the fact that there is a massive amount of historical evidence on the subject. China's late imperial government was arguably more concerned about gender and sexuality among its subjects than any other pre-modern state. How did these and other late imperial legacies shape twentieth-century notions of gender and sexuality in modern China? Susan Mann answers this by focusing on state policy, ideas about the physical body and notions of sexuality and difference in China's recent history, from medicine to the theater to the gay bars; from law to art and sports. More broadly, the book shows how changes in attitudes toward sex and gender in China during the twentieth century have cast a new light on the process of becoming modern, while simultaneously challenging the universalizing assumptions of Western modernity.

Since the first edition of this book, the world's financial system went through its greatest crisis for a century. What made this crisis unique is that severe financial problems emerged simultaneously in many different countries and that its economic impact was felt throughout the world as a result of the increased interconnectedness of the global economy. Written for undergraduate and graduate students of finance, economics and business, the second edition of this successful textbook provides a fresh analysis of the world financial system in light of the recent financial crisis. Combining theory, empirical data and policy, it examines and explains financial markets, financial infrastructures, financial institutions and challenges in the domain of financial supervision and competition policy. This new edition features three completely new chapters, one on financial crises, a second on financial innovation, and, on the policy side, a third on the monetary policy of the European Central Bank.

In Elements of Legislation, Neil Duxbury examines the history of English law through the lens of legal philosophy in an effort to draw out the differences between judge-made and enacted law and to explain what courts do with the laws that legislatures enact. He presents a series of rigorously researched and carefully rehearsed arguments concerning the law-making functions of legislatures and courts, the concepts of legislative supremacy and judicial review, the nature of legislative intent and the core principles of statutory interpretation.

How did the biological, brain and behavioural structures underlying human language evolve? When, why and where did our ancestors become linguistic animals, and what has happened since? This book provides a clear, comprehensive but lively introduction to these interdisciplinary debates. Written in an approachable style, it cuts through the complex, sometimes contradictory and often obscure technical languages used in the different scientific disciplines involved in the study of linguistic evolution. Assuming no background knowledge in these disciplines, the book outlines the physical and neurological structures underlying language systems, and the limits of our knowledge concerning their evolution. Discussion questions and further reading lists encourage students to explore the primary literature further, and the final chapter demonstrates that while many questions still remain unanswered, there is a growing consensus as to how modern human languages have arisen as systems by the interplay of evolved structures and cultural transmission.
